The rules of the game, in plain words.

In short

• tchin.ai is only for people of legal drinking age (18 in Québec). Please drink responsibly.
• The AI’s suggestions are suggestions: they can be wrong.
• Your photos and notes belong to you. We only use them to run the app.
• Subscriptions are billed by the App Store or Google Play and cancelled in their settings.
• You can delete your account at any time. Québec law applies.

1. Who we are

The tchin.ai app and the tchin.ai website are operated by Logiciels E’nergik Software inc., a Québec company (“we”, “us”). By using the app or the website, you accept these terms and our privacy policy. If you don’t accept them, don’t use tchin.ai.

2. Legal age and moderation

tchin.ai is about wine. To use it, you must be of legal age to buy and drink alcohol where you are (18 in Québec). We ask you to confirm this when you first open the app.

tchin.ai doesn’t sell alcohol and doesn’t encourage excessive drinking. Drink responsibly, never drive after drinking and follow the laws where you live. If you are pregnant, take medication or have questions about your health, ask a professional: the app doesn’t give medical advice.

3. Your account

When you first open the app, it creates an anonymous account on your device. To back up your data and get it back on another device, link your Apple or Google account. While your account stays anonymous, your data may be lost if you delete the app, change phones or don’t use the app for a long time (see the privacy policy).

You are responsible for access to your device and to your Apple or Google account. Let us know right away if you think someone is using your account without your permission.

4. Plans and subscriptions

Free plan and Premium

The free plan has limits (for example the number of captures, recommendations or bottles per month), shown in the app. A Premium subscription removes them. Prices, plus applicable taxes, and what each plan includes are shown in the app before you buy.

Billing and renewal

• Subscriptions are bought and billed through Apple’s App Store or Google Play, under their terms, with the payment method on your account with them.
• They renew automatically at the end of each period, at the same price, unless you cancel at least 24 hours before the renewal date.
• You cancel in your App Store or Google Play account settings. Deleting the app or your tchin.ai account doesn’t cancel the subscription.
• After cancelling, you keep Premium until the end of the period you already paid for.

Refunds and price changes

Refund requests go to Apple or Google, under their policies, without limiting the rights the law gives you. If we raise a subscription’s price, we notify you in advance through the App Store or Google Play; you can cancel before the new price applies.

5. Your content

Your photos, notes, comments and lists (“your content”) belong to you. You only give us the right to host, process and display them in order to run tchin.ai for you and for the people you choose to share with. This right ends when you delete your content or your account, subject to the deletion periods in the privacy policy.

You confirm that you have the right to share your content. If a photo shows people, make sure they agree.

6. Acceptable use

You agree not to:

• use tchin.ai if you are under the legal drinking age, or let a minor use it;
• post or share content that is illegal, hateful, harassing or infringes the rights of others;
• get around plan limits, security measures or the app’s verification;
• copy, bulk-extract or resell tchin.ai’s data, recommendations or content, or disassemble the app, except as the law allows;
• overload our servers or use bots to access the service.

7. AI and wine information

tchin.ai uses artificial intelligence to recognise wines, read shelves and receipts, and suggest wines and pairings. These results are generated automatically: they may be incomplete or wrong. Check the label before you buy or open a bottle.

Estimates (drinking window, value, price) are labelled as estimates, with their source. Store prices and availability can change without notice. Stores, producers and brands mentioned in the app are not affiliated with tchin.ai unless stated otherwise. If you have allergies or intolerances (sulphites, for example), rely on the label, not on the app.

8. Evenings and shared cellars

During an evening, other players see your player name, answers and votes, depending on the game. In a shared cellar, members can see and edit the bottles; only the owner can delete the cellar or remove members. Only share a cellar with people you trust.

9. Intellectual property

The app, the website, the tchin.ai brand, the logo, the text, the design and the wine reference data belong to us or our licensors. We give you a personal, non-exclusive, non-transferable and revocable licence to use the app for personal, non-commercial purposes, in line with these terms.

10. Changes to the service

We improve tchin.ai regularly: features may be added, changed or removed. Features marked “Coming soon” aren’t available yet. If we remove a major feature from a paid subscription, we tell you and you can cancel the subscription. We do our best to keep the service available at all times, but can’t guarantee it (maintenance, a provider outage, your internet connection).

11. Liability

tchin.ai is provided to help you discover and manage your wines. To the extent the law allows, we are not liable for indirect losses, such as a bottle you didn’t enjoy, a purchase made on the strength of a suggestion, or data lost with an anonymous account that was never linked.

Nothing in these terms excludes or limits our liability for bodily or moral injury, for intentional or gross fault, or the warranties and rights that Québec’s Consumer Protection Act and Civil Code give you and that cannot be waived.

12. Ending your use

You can stop using tchin.ai and delete your account at any time. We may suspend or close an account that seriously breaches these terms or the law; except in an emergency or where the law requires otherwise, we notify you first and explain why. If we close your account through no fault of yours, we make sure the unused part of your subscription is refunded to you.

13. Apple and Google

These terms are between you and Logiciels E’nergik Software inc., not Apple or Google. We alone are responsible for the app, its content, support and maintenance, and for any claims relating to it (for example about legal compliance, intellectual property or consumer protection). If the app fails to meet an applicable warranty, you may notify Apple, which may refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation to you for the app.

You confirm that you are not subject to a U.S. Government embargo and are not on any list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. The App Store and Google Play terms also apply to your use of their stores.

14. Changes to these terms

We may change these terms to reflect a new feature, a new plan or a change in the law. For any change that affects you, we send you a written notice, in the app or by email, at least 30 days before it takes effect. The notice sets out the new clause, or the amended clause and its previous version, and the date it takes effect.

If you refuse the change, you can stop using tchin.ai and delete your account at no cost or penalty by letting us know no later than 30 days after it takes effect. If the change increases what you pay or reduces what you get, you can also cancel your subscription.

15. Governing law and disputes

These terms are governed by the laws of Québec and the federal laws of Canada that apply there. If you have a problem, write to us first: we always look for a friendly solution.

If you are a consumer, you can bring a claim before the court where you live, including the Small Claims Division of the Court of Québec. Nothing in these terms forces you into arbitration or prevents you from taking part in a class action. You can also contact Québec’s Office de la protection du consommateur.

These terms are written in French. This English version is provided for your convenience; if the two differ, the French version prevails.
